1. Agreement to Terms
Welcome to Toraload. By accessing or using our mobile application and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services. These Terms apply to all users, including customers who request deliveries and drivers who provide delivery services.
2. Description of Services
Toraload is a technology platform that connects customers who need delivery services with independent drivers who have pickup trucks or similar vehicles. We do not provide transportation or delivery services directly. We are not a transportation carrier and do not employ drivers. Drivers are independent contractors who use the Toraload platform to offer their services.
3. User Accounts
3.1 Account Creation
To use Toraload, you must create an account and provide accurate, complete information. You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.2 Driver Requirements
To become a driver on Toraload, you must:
- Be at least 21 years old
- Hold a valid driver's license
- Own or have authorized use of a suitable vehicle
- Provide valid vehicle registration and insurance
- Pass a background check and vehicle inspection
- Comply with all applicable laws and regulations
4. Customer Obligations
As a customer using Toraload, you agree to:
- Provide accurate pickup and drop-off locations and contact information
- Accurately describe the items to be transported, including size, weight, and quantity
- Ensure items are properly packaged and ready for pickup at the scheduled time
- Not ship prohibited items (see Section 6)
- Treat drivers with respect and courtesy
- Pay all fees and charges promptly
- Be present or arrange for someone to be present at pickup and delivery
5. Driver Obligations
As a driver using Toraload, you agree to:
- Maintain valid licenses, registrations, and insurance
- Ensure your vehicle is safe, clean, and roadworthy
- Accept or decline delivery requests only in good faith
- Arrive at pickup and delivery locations on time
- Handle items with reasonable care
- Treat customers with respect and professionalism
- Comply with all traffic laws and regulations
- Not transport prohibited items (see Section 6)
- Maintain accurate location tracking during deliveries
6. Prohibited Items
The following items may not be transported using Toraload:
- Illegal drugs, narcotics, or controlled substances
- Weapons, firearms, ammunition, or explosives
- Hazardous materials, flammable liquids, or toxic substances
- Stolen goods or counterfeit items
- Live animals (except as permitted by law and with prior arrangement)
- Perishable food items requiring refrigeration
- Currency, securities, or precious metals in large quantities
- Items that violate any applicable law or regulation
Toraload reserves the right to refuse service for any items deemed inappropriate or unsafe. Customers who attempt to ship prohibited items may have their accounts suspended or terminated.
7. Pricing and Payments
7.1 Pricing
Delivery prices are determined through offers submitted by drivers. Toraload may provide estimated pricing, but final prices are agreed between customers and drivers. Prices may vary based on distance, item size, demand, and other factors.
7.2 Service Fees
Toraload charges a service fee on each transaction, which is included in the total price displayed to customers. This fee covers the use of our platform, payment processing, customer support, and technology infrastructure.
7.3 Payment Methods
Payments are processed through the app using credit/debit cards, mobile money, or other available payment methods. Payment is charged when the delivery is completed. Customers authorize Toraload to charge the payment method on file.
7.4 Cancellations and Refunds
Customers may cancel requests before a driver accepts. Once accepted, cancellation fees may apply depending on the timing and circumstances. Refunds are issued at Toraload's discretion for valid complaints or service failures.
8. Ratings and Reviews
Both customers and drivers can rate and review each other after completed deliveries. Ratings and reviews should be honest, accurate, and respectful. Toraload reserves the right to remove reviews that violate our policies or contain inappropriate content. Consistently low ratings may result in account suspension or termination.
9. Liability and Insurance
9.1 Toraload's Role
Toraload acts solely as a technology platform connecting customers and drivers. We are not responsible for the conduct, actions, or services of drivers. We do not guarantee the safety, quality, or legality of items transported or the ability of drivers to complete deliveries.
9.2 Driver Insurance
Drivers must maintain valid vehicle insurance as required by law. Toraload does not provide insurance coverage for drivers or customer items. Drivers are independent contractors responsible for their own insurance and liability coverage.
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORALOAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE SIX MONTHS PRECEDING THE CLAIM.
9.4 Item Damage or Loss
Customers should ensure items are properly packaged and insured if valuable. Drivers are expected to handle items with reasonable care. Claims for damaged or lost items must be reported within 24 hours of delivery completion and will be reviewed on a case-by-case basis.
10. Safety and Conduct
All users must:
- Treat others with respect and courtesy
- Not engage in harassment, discrimination, or abusive behavior
- Not use the platform for any illegal or unauthorized purpose
- Not interfere with or disrupt the platform or services
- Report safety concerns or incidents immediately
Violations of these standards may result in immediate account suspension or termination, and may be reported to law enforcement.
11. Intellectual Property
The Toraload app, including its content, features, functionality, design, and logos, is owned by Toraload and protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of our platform without prior written permission.
12. Account Suspension and Termination
Toraload reserves the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, misrepresentation, or any conduct that we deem harmful to other users or our platform. You may also close your account at any time through the app settings.
13. Dispute Resolution
Any disputes arising from these Terms or use of our services shall be resolved through binding arbitration in accordance with the laws of Zimbabwe. You agree to resolve disputes individually and waive any right to participate in class actions or collective proceedings.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through the app or via email. Your continued use of Toraload after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using our services.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of Zimbabwe, without regard to conflict of law principles.

17. Miscellaneous
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms constitute the entire agreement between you and Toraload regarding our services.
